Terms of Use

These Terms of Use (the “Terms”) are an agreement between you and State Street Brats (“State Street Brats,” “we,” “us,” or “our”) governing your access to and use of this website and the products and services offered through it. Please read them carefully. They include important limitations on our liability and, where applicable, affect how disputes are resolved.

1. Acceptance of these terms

By accessing or using this website, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the site. If you use the site on behalf of a business or other organization, you represent that you are authorized to bind that organization to these Terms.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority where you live, to use this site, place an order, or create an account. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your password confidential and notify us promptly of any unauthorized use. We may suspend or terminate accounts, and refuse or cancel orders, at our discretion, including where we suspect fraud, abuse, or a violation of these Terms.

3. Orders, pricing & payment

All orders are offers to purchase and are subject to our acceptance. We may decline or cancel an order for any reason, including product unavailability, errors in pricing or product information, or suspected fraud, even after an order is submitted or a confirmation is sent. If we cancel an order you have already paid for, we will issue a refund for the affected items.

Prices, fees, taxes, and availability are subject to change without notice and are confirmed at checkout. Despite our efforts, products on the site may occasionally be mispriced or described inaccurately; we reserve the right to correct errors and to cancel any order placed based on incorrect information. Payment is due at the time of order unless we have agreed in writing to other terms (see Business gifting & invoicing). You authorize us and our payment processor to charge your selected payment method for the total shown at checkout, including taxes and shipping.

4. Shipping & perishable goods

Shipping options, costs, and estimated delivery windows are shown at checkout and are estimates only. We are not responsible for delays caused by carriers, weather, incorrect or incomplete addresses you provide, or other events outside our reasonable control. Title and risk of loss pass to you (or to the gift recipient you designate) upon our delivery of the goods to the carrier, unless applicable law requires otherwise.

Many of our products are perishable food items. Perishable goods are shipped using methods intended to maintain quality in transit, but you are responsible for providing an accurate, deliverable address and for promptly receiving and refrigerating perishable items on delivery. Because of their nature, perishable and food items are not returnable, and we are not responsible for spoilage resulting from delivery to an incorrect address, a failure to be available to receive the shipment, or improper handling after delivery. If a perishable order arrives damaged or defective, contact us promptly (see Cancellations & refunds).

We ship only to destinations we make available at checkout. We do not guarantee that any product can be shipped to every location, and some products may be restricted by destination.

5. Alcohol

We do not sell or ship alcoholic beverages through this website. Alcohol is served only on-premises at our location to guests who are of legal drinking age and can present valid government-issued identification. References to beer, cocktails, or other alcoholic beverages on this site are informational and are not an offer to sell or ship alcohol. We reserve the right to refuse service and to verify age and identification at our discretion, consistent with applicable law.

6. Business gifting & invoicing

We offer a business gifting program through which business customers may order gifts to be shipped to recipients they designate. If you use this program, you are responsible for the accuracy of the recipient information you provide and for obtaining any necessary permission to share recipients' details with us for the purpose of delivering gifts. You authorize us to contact recipients as needed to confirm delivery details.

Where we expressly agree in writing to extend invoicing or other payment terms to a business customer, payment is due according to the terms stated on the applicable invoice or agreement. Amounts not paid when due may be subject to suspension of service and to any late charges or collection costs permitted by law and by our agreement with you. Approval of invoicing terms is at our sole discretion and may be withdrawn.

7. Cancellations & refunds

Because many of our products are made to order or perishable, cancellation and refund eligibility depends on the product and the timing of your request. Perishable and food items are not returnable. If your order arrives damaged, defective, or materially not as described, contact us promptly — and in any event within 7 days of delivery — with your order number and a description (and, where helpful, photos) so we can make it right. Remedies, where offered, may take the form of a replacement, credit, or refund at our discretion. Non-perishable merchandise may be returnable subject to the conditions we state at the time of sale.

8. Acceptable use

You agree to use this site only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable law or regulation, or infringe the rights of others;
• Submit false, misleading, or fraudulent information, or use another person's payment or identity without authorization;
• Interfere with or disrupt the site, its security, or its underlying systems, or attempt to gain unauthorized access to any account or data;
• Use any automated means to scrape, harvest, or collect information from the site without our prior written permission; or
• Upload or transmit any malware, or any content that is unlawful, infringing, defamatory, or otherwise objectionable.

9. Content you submit

If you submit content to us through the site — for example, a photo, review, message, application, or form response (“Submissions”) — you represent that you have the right to do so and that the content does not infringe anyone's rights or violate any law. You retain ownership of your Submissions. By submitting content, you grant State Street Brats a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, store, reproduce, adapt, and display that content in connection with operating and promoting our business, to the extent permitted by law and consistent with our Privacy Policy. We are not obligated to use, monitor, or retain any Submission, and we may remove content at our discretion. Do not submit content you do not want us to use in this way.

10. Our intellectual property

The site and its content — including text, graphics, logos, images, designs, and the “State Street Brats” name and marks — are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the site for your personal, non-commercial use, or for your internal business use of our gifting program. You may not copy, reproduce, distribute, modify, or create derivative works from our content, or use our name or marks, without our prior written permission.

11. Third-party services & links

The site links to and integrates services operated by others — including off-site ordering and reservation platforms, payment and shipping providers, and embedded content such as our beverage tap-list. We do not control, and are not responsible for, the availability, content, products, or practices of those third parties. Your use of a third-party service is governed by that party's own terms and privacy policy, and any transaction you enter into with a third party is solely between you and that party.

12. Disclaimers

The site and all products, services, and content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on the site is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, State Street Brats and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the site, products, or services, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the site, products, or services will not exceed the greater of the amount you paid to us for the product or service giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, and some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless State Street Brats and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, your Submissions, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Governing law & disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. Subject to any dispute-resolution provision below, you agree that any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in Dane County, Wisconsin, and you consent to the jurisdiction of those courts.

16. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes take effect when posted, and your continued use of the site after that constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the site.
